Today, the agent holds the fiduciary position. However, most agents behave like functionaries because they have never had this challenged. The challenge is that the consumer may now assume that functionary is fiduciary; therefore, if the Internet delivers good functionary services, the consumer will think they are actually getting fiduciary services.
